1. What this is
An informational website about a casino card game, and a free browser-based simulator of it. By using either you accept these terms.
2. The Simulator is not gambling
It uses no real money. Chips, cash, bankrolls, markers and the progressive meter have no value of any kind. They cannot be purchased, sold, transferred, exchanged or redeemed for money, goods, services or anything else, on this site or anywhere else. There is no in-app purchase, no payment of any kind is accepted, and there is no prize.
No part of The Simulator is a sweepstakes, a contest, a lottery, or a game of chance played for anything of value, and no element of it constitutes gambling. It is not a gambling service and it is not licensed as one, because it does not need to be.
3. No guarantee of outcomes
Nothing on this site or in the book beats the house edge. Every casino game described here is expected to lose money over time. The material is educational: it explains how the game works and what different ways of playing it cost. It is not legal, tax or financial advice, not investment advice, not betting advice, and not a system. Gambling law and the tax treatment of winnings vary by country and by state and both change; if a decision turns on either, ask somebody qualified where you live.
Results in The Simulator predict nothing about results anywhere else.
4. Accuracy
Figures are computed by exhaustive enumeration and we believe them correct, but they are provided without warranty. Casino rules and pay tables vary by property and change without notice. The sign in front of you is the only one that counts.
5. Age
This site concerns gambling and is intended for adults - 21 in most of the United States, 18 in some jurisdictions. If you are below the legal age where you are, please do not use it.
5a. Where you are
Gambling law varies enormously by country and by state, and so does the law on writing about it. You are responsible for knowing what is lawful where you are and for complying with it. This site is operated from the United States, is not directed at anyone in a jurisdiction where this material or access to it is restricted, and nothing here is an offer to provide any gambling service to anybody anywhere.
5b. Acceptable use
Please do not: scrape or bulk-download the site; access it by automated means, including crawlers and headless browsers, other than well-behaved search indexing; reverse engineer, decompile or extract the source of The Simulator; frame, mirror or republish the site or any substantial part of it; or remove or obscure any notice on it.
6. Intellectual property
The book, the site text, the cover and The Simulator are copyright Keith Adler. All rights reserved. The Simulator is free to use and is not open source - you may play it here, and that is the whole of the licence.
Separately, the reference implementation used to verify the book's figures is published at github.com/keithadler/win-at-3-card-poker, under the MIT licence, so its arithmetic can be audited. That is the code behind the numbers, not the code behind this website. The Simulator's own source is not published.
Three Card Poker® and Pair Plus® are marks of their respective owners. They are used here only to describe the game this site is about. This site is independent and is not affiliated with, endorsed by, sponsored by or licensed by them or by any casino.
7. Liability
The site is provided as is. To the maximum extent the law allows, we are not liable for any loss arising from its use - including gambling losses. Where liability cannot lawfully be excluded, it is limited to one hundred United States dollars, which reflects the fact that this site is free and takes no money from anybody. Nothing here excludes liability that cannot lawfully be excluded, and if you are a consumer your statutory rights are unaffected.
7a. Indemnity
If your use of the site in breach of these terms causes a claim against us, you agree to cover the reasonable cost of dealing with it.
8. Links out
We link to other sites we do not control and are not responsible for their content.
9. Governing law and venue
These terms are governed by the laws of the State of Ohio, United States. Any dispute will be brought in the state or federal courts sitting in Ohio, and both sides submit to the jurisdiction of those courts. If you are a consumer resident elsewhere, you keep the protection of the mandatory laws of your own country, and you may bring proceedings in your local courts where the law gives you that right.
9a. User content
This site hosts no user-submitted content. There is nowhere to post, upload or comment. If that ever changes, a designated DMCA agent and a notice-and-takedown procedure will be published here before any such feature opens.
9b. Changes to these terms
These terms may change. The current version is always the one on this page and the date at the top is when it last changed, with a short note of what changed at the foot of the page. Material changes will be flagged on the home page for a reasonable period. Continuing to use the site after a change means you accept the revised terms; if you do not, stop using the site.
9c. The rest of it
Severability. If any part of these terms is unenforceable, the rest still
stands.
Entire agreement. These terms are the whole agreement between us about the site.
No waiver. Not enforcing something once does not give it up.
Assignment. You may not transfer your rights under these terms. We may transfer
ours if the site or the book changes hands.
Survival. Sections 3, 4, 6, 7, 7a and 9 survive any end to your use of the site.
